About Connected Learning Foundation
Connected Learning Foundation Ltd (88 689 986 641) is a company limited by guarantee established to prevent behaviour that is harmful or abusive to young people. This includes bullying, social exclusion, self-harm, discrimination, aggression, emotional harm and other behaviours that negatively impact the wellbeing of children and young people.
Donations support programs such as education, mentoring, support initiatives, research and community collaboration that build resilience, emotional regulation, social intelligence and positive peer relationships in children and young people.
Acceptance of these terms
By making a donation to Connected Learning Foundation through this website, by bank transfer or by any other method, you are taken to have accepted these Terms & Conditions.
If you make a donation on behalf of an organisation or another person, you warrant that you are authorised to do so and that the organisation or person has also agreed to these terms
Nature and use of donations
All donations are voluntary and will be applied solely to further the Foundation’s charitable purposes as set out in its Constitution and related harm-prevention activities, unless a specific project is clearly identified at the time of donation.
The Board may decide how best to apply donations within those purposes, including reallocating funds between programs or projects to ensure they are used where the need is greatest, while remaining consistent with the Foundation’s charitable objects.
Deductible Gift Recipient (DGR) status and receipts
The Foundation is currently not endorsed as a Deductible Gift Recipient (DGR) under the Income Tax Assessment Act 1997, but is in the process of applying for DGR endorsement for an appropriate fund or sub-entity.
Until DGR endorsement is granted and publicly confirmed by the Australian Taxation Office (ATO), donations are generally not tax deductible; the Foundation will clearly update this notice and any relevant materials if and when DGR endorsement takes effect.
One-off and recurring donations
Donations may be made as:
One-off payments (for example, by card, bank transfer or other available payment methods).
Recurring or subscription donations (for example, monthly or quarterly) where this option is offered on the website or via a donation form.
If you choose a recurring donation, you authorise the Foundation (or its payment provider) to debit the nominated payment method for the agreed amount and frequency until you change or cancel that arrangement in accordance with these terms.
Changing or cancelling recurring donations
You may request a change to the amount or frequency of your recurring donation, or cancel it altogether, by contacting the Foundation using the contact details on this website with at least 5 business days notice before the next scheduled payment date.
The Foundation will take reasonable steps to process changes or cancellations promptly; however, where a request is received too close to the processing date, the change may take effect from the following cycle.
Payment processing and security
Online donations are processed via third-party payment providers (such as payment gateways or merchant facilities) which use industry-standard security measures to protect your payment details.
The Foundation does not store full credit card information on its own systems and will handle any personal information in accordance with its Privacy Policy, which is available on this website and forms part of these terms.
Refunds and unauthorised transactions
As a general principle, the Foundation does not provide refunds for donations where a donor has changed their mind, given the charitable nature of the contribution and the Foundation’s need to plan and commit resources.
However, the Foundation may consider a refund in limited circumstances (for example, where there has been an obvious error, duplicate payment, or unauthorised transaction) if requested within 30 days of the transaction and supported by appropriate evidence.
If you believe there has been an error or unauthorised transaction, you should contact the Foundation as soon as possible with details of the date, amount, payment method and any reference number so that the matter can be investigated.
Donor information and privacy
The Foundation collects personal information (such as your name, contact details and donation history) to process donations, issue receipts, comply with legal obligations and keep you informed about its work, unless you opt out of communications.
Personal information is managed in accordance with the Foundation’s Privacy Policy and applicable privacy laws; you may request access to, or correction of, your personal information by contacting the Foundation using the details published on this website.
Compliance with fundraising and governance requirements
The Foundation will comply with applicable fundraising laws, including the Charitable Fundraising Act 1991 (NSW), the Charitable Fundraising Regulation and any conditions of a fundraising authority, to the extent these apply to its activities.
The Foundation will also comply with the ACNC Governance Standards, including requirements to manage its financial affairs responsibly, act in the best interests of its charitable purposes, and maintain accurate financial and operational records relating to fundraising.
Where the Foundation solicits donations from other Australian states or territories, it will take reasonable steps to understand and meet any additional local fundraising requirements that apply to those appeals.
Donor conduct and restrictions on donations
The Foundation may, at its discretion, refuse, return or refund a donation (in whole or in part) where:
Acceptance would be inconsistent with the Foundation’s charitable purposes or values.
Acceptance might reasonably be expected to damage public trust and confidence in the Foundation.
Acceptance could place the Foundation in breach of any law, regulatory obligation or funding condition.
Where practicable, and subject to any legal requirements, the Foundation will discuss concerns with the donor and may offer to redirect or refund the donation if it cannot be accepted on the proposed terms.
Communications and acknowledgements
Unless you request otherwise, the Foundation may contact you to:
Acknowledge your donation and provide a receipt.
Share updates on projects, impact and opportunities to support the Foundation’s work.
You can opt out of non-essential communications at any time by following the unsubscribe instructions in emails or by contacting the Foundation; operational communications (such as receipts or notices relating to recurring donations) will still be sent.
Disclaimers and limitation of liability
While the Foundation takes reasonable care in describing its programs and intended use of donations, outcomes may vary and no specific results are guaranteed for any individual donor or beneficiary.
To the maximum extent permitted by law, the Foundation excludes all liability for any loss or damage (including consequential loss) arising in connection with your donation or use of this website, except where caused by the Foundation’s fraud, willful misconduct or statutory obligations.
Nothing in these Terms & Conditions limits any rights you may have under the Australian Consumer Law or other non-excludable legal rights.
Changes to these terms
The Foundation may amend these Terms & Conditions from time to time, for example to reflect changes in law, fundraising practices, DGR endorsement or internal policies, by publishing an updated version on this website.
The version in force at the time of your donation will apply to that donation; continued use of the website and any new donations after changes are published will be taken as acceptance of the updated terms.
